The handout of the device and the submission hereof implies acceptance by the User of the following conditions
OBJECT
The Establishment provides the User with a mobile internet access service called "GoBox" by means of the provisiol:n of a 4G-connected mobile router for the number of days and for the price defined above.
ARTICLE 1. DEFINITIONS
The expressions and capitalized terms of the Terms of Use will have the following definition:
Device: "Huawei" type equipment provided by the Establishment and made available to the User to enable him to access the Internet and whose activation to the Internet is permitted through the authentication of the User.
Equipment: Device with which the User will connect to the GoBox service.
Internet: a global data exchange network consisting of servers interconnected through electronic communications networks, accessible to any user with the necessary computer equipment.
GoBox service: refers to the Mobile Internet Access provided to the User by the Establishment by means of the Device.
User: means any natural person who uses the GoBox Service.
WiFi: A set of wireless communication protocols governed by IEEE 802.11 (ISO / IEC 8802-11) standards for wireless digital data transmission.
ARTICLE 2. CONDITIONS OF USE OF THE GOBOX SERVICE
2.1. Connection conditions
In order to benefit from the GoBox Service, the User must first connect his Equipment to the GoBox network. The connection technology depends on the connection location.
The connection to the GoBox network by a WiFi technology can only be done if, on the one hand, the User has installed a WiFi adapter on his Equipment and that, on the other hand, the User Equipment is located in an area covered by Bouygues' 4G network.
Once its Equipment is connected to the GoBox network, the User must ensure that his Equipment has a standard network configuration: in particular, an IP address and DNS servers configured to be obtained automatically by DHCP, and a system of firewall and anti-virus not limiting Internet browsing. The user must then open his Internet browser.
2.2. Terms of use
Throughout the duration of the contract; it is up to the User to ensure (i) the absence of degradation of the Device by preserving it from any shock, disassembly, intrusion, breakage, overheating, immersion in a liquid and more generally any use contrary to its destination or infringing on its robustness and/or functionality and (ii) the conservation of the Device by taking all precautions against theft, refraining from leaving it unattended in a place accessible to the public or in a private place and more generally in providing constant care.
In case of loss, theft or degradation of the Device, the Establishment reserves the right to charge in addition to the price of the provision of the service a fixed fee corresponding to the amount deposited as a security deposit by the User at the time of the subscription to the GoBox service.
2.3. General obligations
2.3.1 The User guarantees the accuracy of the information provided during his identification. The User declares to be well informed about the intrinsic characteristics of the Internet and in particular because (a)the transmission of data on the Internet only enjoys a relative reliability, these circulating on heterogeneous networks, characteristics and capacities various, which are sometimes saturated at certain times of the day and likely to impact download times or data accessibility; (b)that the data circulating on the electronic communications networks may be diverted and the communication by the User of confidential data is done at his own risk; (c)that the Internet is an open network and, as a result, the information it conveys is not protected against the risks of diversion, intrusion into the Equipment, hacking of data, programs and files Equipment, contamination by computer viruses; (d)it is his responsibility to take all appropriate measures to (i)protect the data, files or programs stored in the Equipment against contamination by viruses circulating on electronic communications networks, in particular on the Internet, and attempts to intrude into the Equipment; and (ii) prevent misuse by third parties of the access made available.
2.3.2 Users also acknowledge that they have an obligation to monitor the use of their access to the Internet, for which they alone are responsible. As such, the User further undertakes to respect, or enforce, any person using the GoBox Service, in particular the following rules:(a)data circulating and / or made available on electronic communications networks (especially on the Internet) must not contravene applicable national or international laws, regulations, codes of practice or professional ethics. In particular, any content intended in particular to provoke crimes and offenses, incitement to racial hatred or suicide, apology for crimes against humanity, containing elements of child pornography, or violent or pornography is strictly prohibited when the content is likely to be accessible to minors is strictly prohibited; (b) the User, by his behavior and by the data he makes available, undertakes not to (i) infringe the rights of third parties, in particular by the reproduction, representation, making available or the communication to the public of works or objects protected by intellectual, literary, artistic or industrial property rights. Data circulating or made available on any electronic communications network (in particular on the Internet) and / or made available by means of audiovisual services may be regulated in terms of use or protected by copyright or by a neighboring right and the User is solely responsible for the use of the data that he consults, stores and makes available on the electronic communication networks (especially on the Internet) and the services, the propagation of data, images or images. sounds that may constitute defamation, an insult, a denigration or an invasion of privacy, the right to the image, morality or public order; (ii)use the GoBox Service for counterfeiting (piracy) purposes; (iii) download files under unlawful conditions or make available protected files (texts, images, photographs, musical works, audiovisual works, software and video games), regardless of the means used; (iv)intrude into computerized systems or "hacking"; (v) spreading viruses, or any programs intended to harm; (vi) disseminate e-mails under unlawful conditions;(c)data that allows via the creation of a hypertext link to sites or pages of third parties to violate a provision above or more generally a legal provision are prohibited.
2.3.3 As a result of the foregoing, the User acknowledges that the Establishment and its assigns cannot be held responsible for the consequences of the occurrence of one or more of the aforementioned facts and that under the law in force, the Establishment is not subject to a general obligation to monitor data, nor to a general obligation to seek facts or circumstances revealing unlawful activities.
2.3.4 The User acknowledges that access to the GoBox Service may be temporarily suspended due to the maintenance of the network, its improvement or the occurrence of a case of force majeure.
ARTICLE 3. THE GOBOX SERVICE
The GoBox Service allows the User to access the Internet and its various services, including the World Wide Web (WWW), e-mail, online services consultation, file exchange and, more generally, the exchange of data across the network.
3.1 User Identification
Use of the GoBox Service is exclusively reserved for natural persons, adults and persons with legal capacity. A systematic authentication of the User is required to activate the internet connection (at least by entering his e-mail address and a password or even the verification of the mobile number via the sending of a code by SMS may be required on certain Connection Places). Access to the GoBox Service is thus a strictly personal service.
3.2 Right of access to the GoBox Service
Access to the GoBox Service is subject to payment according to the price conditions communicated by the Establishment to the subscription of the service.
ARTICLE 4. OBLIGATIONS OF THE ESTABLISHMENT
The Establishment is expressly subject to an obligation of means in the provision of the GoBox Service and is not responsible for the quality of data transmission, information response times and any restrictions on access to specific networks or services. connected to the Internet.
In the event of a malfunction of the GoBox service, the Institution undertakes to suspend any payment of the billing of the service after the return by the User of the Box and to provide the User, depending on the available stock, another box in substitution for the duration of the rental period.
ARTICLE 5. PERSONAL DATA OF THE USER
The User is informed of the collection by the Establishment of personal information to ensure the proper performance of the services herein.
The establishment commits to:
- use the personal data of the User for the purpose of performing services associated or not with other services provided by the Institution;
- take all necessary precautions, in view of the nature of these personal data and the risks presented by the processing, to preserve the confidentiality and the security of the data and, in particular, to prevent that they are deformed, damaged, or that third parties are not allowed access.
